WHEN AND WHERE DO I GET THE KEYS?
The keys will either by held by the owner, his solicitor, Estate Agent or neighbour. Legally they should not be released until the seller has moved out of the property and he is capable of giving vacant possession in accordance with the terms of the contract. Understanding and responsibility by all parties plays an important part at this stage.
A first-time buyer for cash given due notice should have no difficulty in providing funds on the purchase date for a time of 10.30 a.m. If money is being transmitted by his solicitors, he will not attempt this until the morning of the agreed date. This can only cause delay that often rebounds along the chain of dependent transactions resulting in the buyer at the top of the chain having to be very patient as it may be late in the day before he is able to obtain release of his keys and gain access, simply because his money has not reached its destination early enough and the owners legal representatives will not release the keys. Inconvenience is obviously kept to a minimum but some solicitors are less understanding than others. Please try to bear in mind that notwithstanding the legal position and the efforts we make, it is impossible to synchronise a legal completion appointment with a removals van. Few completions can take place before banks open at 9.30 a.m. yet removals van are often arrange from 7.00 a.m.
Release of keys require a little give and take on all sides in a chain of transactions.
If a buyer arrives at the property very early in the morning on the completion date he may find that he has to wait around for several hours before the keys are released. This obviously cause frustration and inconvenience and buyers are therefore advised not to expect to receive the keys until around 1.00 or 2.00 p.m. on the completion date.
